End User License Agreement

1. Grant of License

SwiftCap EAs grants you a limited, non-exclusive, non-transferable, revocable license to use the Software on MetaTrader 4 or MetaTrader 5 platforms, subject to the terms of this Agreement.

2. License Scope

• Monthly / Quarterly: Valid for the duration of the active subscription period.
• Lifetime: Valid indefinitely, subject to continued compliance with this Agreement.
• Account Limits: Per product tier (up to 5 trading accounts per EA, as specified at purchase).

3. License Validation

The Software requires periodic online validation to confirm an active license. During validation, the Software transmits your license key, trading account number, and hardware identifier to our servers. No trading data, account balances, or positions are transmitted.

4. Restrictions

You may NOT:

• Copy, distribute, sell, lease, sublicense, or transfer the Software or your license key
• Share your license key with any other person or entity
• Reverse engineer, decompile, disassemble, or attempt to derive source code
• Bypass, circumvent, or attempt to disable license validation mechanisms
• Activate the Software on more trading accounts than your license permits
• Use the Software for any commercial purpose without a commercial license

5. Intellectual Property

The Software is the exclusive intellectual property of SwiftCap EAs. This Agreement does not transfer any ownership rights. All rights not expressly granted are reserved by SwiftCap EAs.

6. No Financial Advice

The Software is a technological tool and does not constitute financial advice, investment advice, or a recommendation to trade. You are solely responsible for all trading decisions made using the Software.

7. Risk Acknowledgment

Forex and CFD trading involves substantial risk of loss. Past performance of the Software does not guarantee future results. The Software may produce losses. You acknowledge that you are trading with money you can afford to lose and that you alone are responsible for the outcome of your trading activity.

8. No Warranty

The Software is provided "AS IS" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. SwiftCap EAs does not warrant that the Software will be error-free or uninterrupted.

9. Limitation of Liability

SwiftCap EAs shall not be liable for trading losses, lost profits, data loss, or any consequential, incidental, indirect, or special damages arising from your use of the Software. Our total liability to you under this Agreement shall not exceed the amount you paid for the license.

10. Termination

This license terminates immediately and without notice upon your violation of any term of this Agreement. Upon termination, you must cease all use of the Software and delete all copies in your possession. No refund will be issued upon termination for violation of these terms.

11. Updates

SwiftCap EAs may release updates to the Software at its discretion. Updates may be required to continue using the Software. Continued use of the Software after an update constitutes acceptance of any modified terms accompanying that update.

12. Governing Law

This Agreement shall be governed by and construed in accordance with applicable laws. Any disputes arising under this Agreement shall be resolved through binding arbitration rather than in a court of law.

13. Entire Agreement

This End User License Agreement, together with the Terms of Service and any other policies referenced herein, constitutes the entire agreement between you and SwiftCap EAs regarding the Software and supersedes all prior agreements, understandings, or representations relating to the same subject matter.
